By accessing, browsing, or using this PTIF website (including enrolling in any Program) (“Site”), you agree to be bound by these terms, conditions and disclaimers as amended from time to time (“Terms”). These Terms form part of, and are subject to the provisions of, our Privacy Policy (https://ptif.com.au/privacy-policy). Please read these Terms carefully before using this Site.
If you do not agree to be bound by these Terms, then please immediately discontinue your use of the Site.
PTIF may amend these Terms and Conditions from time to time without notice. Any amendment will be effective immediately upon being posted on this Site. Your continued use of this Site after any amendment becomes effective will constitute your agreement to be bound by these Terms and Conditions, as amended.
DEFINITIONS
In these Terms, unless otherwise provided, the following words have the following meanings:
BASIS OF AGREEMENT
An Agreement is accepted by PTIF when PTIF accepts, a purchase by the Participant via our online store.
PTIF may refuse to accept any Participant’s purchases in its sole discretion.
The Participant’s online purchase is not transferable. By accepting these Terms, the Participant warrants that it is the person participating in a PTIF service.
By purchasing any PTIF service, the Participant accepts the following terms and conditions. The Participant:
(a) agrees that it will pay all session costs required to be paid by the Participant to participate in any service offered by PTIF in the PTIF online shop (https://ptif.com.au/shop/);
(b) agrees that it will undertake the session in a responsible and safe manner;
(c) warrants that the information it has provided to PTIF, whether directly or indirectly, or through the Site is:
(i) provided in good faith; and
(ii) true and correct to the best of the Participant ‘s knowledge, information and belief;
(d) agrees that it will provide a current and accessible email address at which the Participant can be contacted prior to any session.
(e) agrees to receive important session information and marketing materials (such as newsletters social media campaigns) via e-mail unless they opt-out in writing.
(f) agrees that it is entirely responsible for maintaining the confidentiality of the Participant’s User Name and Password for the Site;
(g) agrees that it is entirely responsible for any and all activities that occur under the Participant’s User Name and Password on the Site;
(h) agrees that it will notify PTIF immediately of any unauthorised use of the Participant’s User Name and Password or any other breach of security;
(i) undertakes that it will not engage in conduct which does or tends to defeat or compromise the purposes of the sessions including:
(ii) failing to comply with instructions;
(iii) misrepresenting, falsifying, misstating or fabricating data, results or information.
(j) agrees that PTIF may make changes to the session(s)including changing, cancelling or postponing dates;
(k) agrees that it may be refused the right, in PTIF’s sole discretion, to participate in sessions.
DISCLAIMER
The Site is provided only for general information about mental health therapies and related services to inform, educate and support participants (collectively referred to as “Information”).
The Site is not a clinical tool and the Information must not be used to diagnose any form of illness, disease or any other medical condition and it must not be used to diagnose conditions or prescribe or vary any treatments. The contents of any page of this website and resources do not constitute medical advice, are not intended to be a substitute for medical advice and should not be relied upon as such.
PTIF does not warrant, guarantee or make any representation regarding the accuracy, adequacy, reliability, relevance, completeness or timeliness of the Information or that it is suitable for your intended use. The Information is provided by PTIF in good faith on an “as is” basis without warranty of any kind.
It is your responsibility to assess the accuracy, relevance, adequacy, reliability, completeness and timeliness of the Information and to assess whether the Information is suitable for your use.
The Information provided is of a general nature only and should not be used as the basis for making any decision, without consulting a mental health professional.
The Site may contain historical Information that is not current and is provided for reference purposes only.
The Information does not constitute professional advice and must not be treated as a substitute for the advice of a mental health professional.
PTIF does not warrant or represent that the Information is free from human or mechanical error, technical inaccuracies or other typographical errors or defects. The use of this Site and the Information is at your own risk.
PTIF reserves the right to vary or modify the Information contained on this Site, to change or discontinue any service, feature or part of this Site, to change the hours of availability and the equipment required to obtain access to this Site, without notice and without liability.
PTIF makes no warranties, guarantees or representations that the material in this Site will not cause damage or that the material is free from any computer virus or other defects. It is your responsibility to complete a virus check on any Information viewed or downloaded.
PTIF reserves the right to suspend or terminate your access to the Site at its sole discretion for any reason.
PTIF will use reasonable endeavours to ensure that the Site is available continuously, however PTIF does not guarantee that access to the Site will be continuous or uninterrupted.
LIMITATION OF LIABILITY
All warranties, representations and implied terms and any liability which may arise in relation to your access to or use of this Site, participation in any service or the Information are expressly excluded to the extent permitted by law.
PTIF, its creator, and its funding bodies will in no way be liable to any party for any injury, loss or damage arising out of or related to the use (or the inability to use) the Information on this Site.
Under no circumstances will PTIF, its creators, and its funding bodies be liable for any direct, indirect, incidental, special or consequential loss or damage, including loss of programs or data.
If your use of this Site results in the need for servicing or replacing of equipment, PTIF, its creator, and its funding bodies will not be liable for those costs.
PTIF its creators, and funding bodies will in no way be liable for any injury, loss or damage suffered by any person as a result of the failure to comply with these Terms and Conditions or any other form of improper use of the Site.
If the Participant is a consumer nothing in these Terms restricts, limits or modifies the Participant’s rights or remedies against PTIF for failure of a statutory guarantee under the ACL.
COSTS, REFUNDS, CANCELLATIONS & TRANSFER
PTIF will charge the Participant the cost for any services.
The Cost charged for the Participant’s participation in any service is exclusive of GST, which is additionally to be paid by the Participant if required.
Payment of the Costs is due immediately at point of sale upon the Participant’s purchase for participation in any Service.
If a Participant repeatedly does not respond to reasonable attempts by PTIF to contact it, the Participant will be deemed to have withdrawn from or abandoned the online purchase/Sale.
Requests for any full or partial refund of the Fee paid by the Participant will be handled in accordance with PTIF’s policy as set out in these Terms.
Notification of withdrawal, cancellation and/or requests for refunds must be made by the Participant in writing to PTIF at support@ptif.com.au.
The Participant acknowledges and agrees that, to the maximum extent permitted at law, PTIF is not liable to the Participant and no refund is payable by PTIF in the following circumstances:
(a) where the Participant changes its mind after completing the point-of-sale transaction in the act of purchasing a service.
No refunds of the costs will be made for the discontinuance or abandonment of any paid service.
Strictly subject to availability and at the sole discretion of PTIF, the Participant may be eligible for a service transfer to a different service offered by PTIF. Such transfer will incur an administration fee of AUD $50 (excluding GST).
Agreeing to the Refund policy set out in these Terms does not restrict or remove the right of the Participant to take further action where permitted under the ACL or to pursue other legal remedies.
LINKS TO OTHER SITES
You may from time to time be able, through hypertext or other computer links, to gain access to other Sites operated by other third parties (“Linked Sites”).
The Linked Sites may have different Terms and Conditions.
Unless otherwise specified, the Linked Sites are not under PTIF’s control. The Linked Sites may have different Terms and Conditions. PTIF is not responsible for the content of any Linked Sites, or any changes or updates to such sites. PTIF provides these links for your convenience only. You link to any such Linked Sites at your own risk. PTIF is not a party to any transaction between you and a provider of a Linked Site. PTIF does not sponsor, endorse, adopt, confirm, guarantee or approve of any material or representations made in those Linked Sites.
